Why Compliance Is the New Currency of Real Estate

7 March 2026 · Sipho Mahayi, principal property practitioner

In property, trust works like a currency, and compliance is how an agent earns it before anyone knows him personally. A seller cannot see an agent's character on the first visit, but she can check whether he is registered.

Every estate agent in South Africa must hold a valid Fidelity Fund Certificate issued by the Property Practitioners Regulatory Authority, and the regulator keeps a register that anyone can search. An agent who holds money for clients must keep it in a trust account that is audited. Before taking a mandate, the agent should have the seller complete a disclosure form about known defects, which then goes with the sale. It is not glamorous work. Each piece is a small proof that someone outside the deal is watching.

A family selling the house they have lived in for decades may be choosing between two agents with similar valuations and similar smiles. One shows his certificate, explains where any deposit will be held and goes through the disclosure form line by line. The other promises a quick sale and says the paperwork will sort itself out. The first has given them something they can verify. The second has asked for faith.

That is why compliance behaves like money in this business. It buys trust, and it can be lost overnight, because a certificate that lapses or a trust account that does not balance takes the trust straight down with it.
