Strategic Refusal Is an Underrated Form of Power

28 March 2026 · Sipho Mahayi, principal property practitioner

Some of the best decisions in property are mandates that were never signed.

Say a seller mentions, almost in passing, that the main bedroom wall gets damp every rainy season, and that the patch was painted over last month. Then he asks that it not be mentioned to buyers, because the sale is voetstoots anyway. Many people believe that clause covers everything. It does not protect a seller who knew about a hidden defect and concealed it, and an agent who goes along with the silence can become part of the problem when the buyer's first rainy season in the house arrives.

The agent who refuses that listing loses a commission on paper. What they keep is worth more. They keep a clean record with the property regulator and a name buyers can trust, and they avoid months of letters between attorneys. They also send a message that travels. Sellers start to learn what this agent will and will not do, and the ones who want to hide things stop calling.

That last part is the real power in refusing. Each well-chosen no filters the work that comes next. Over time the agent who refuses carefully ends up with better listings than the one who takes everything, simply because the troublesome sellers have learned to look elsewhere.
