Dispatch #235

A tenant late twice was never late by accident.

1 October 2026 · Sipho Mahayi, principal property practitioner

A rent due date is the day the lease says payment must reach the landlord, usually the first of the month, and it is set by the landlord without much thought about when the tenant is actually paid. Many tenants earn in the middle of the month, or rely on clients who settle invoices whenever they choose. For them the first late payment looks like an accident. The second shows that the lease and the income are running on different clocks, and two clocks that do not line up will keep not lining up. Nobody has to be dishonest for this to happen. The rent simply slides a little later each month as other bills compete for the same money.

Seen as structure rather than character, it can sometimes be fixed with paper. A landlord who mainly wants reliable rent can agree, in writing, to a due date that follows payday, and amend the lease to match. Another may prefer to send a letter of demand and hold the tenant to the original date, which the lease allows. Treating the second late payment as a coincidence is the one response that fixes nothing. It will be back on the same day next month.
