Dispatch #251

The signature delayed twice was never really promised.

17 October 2026 · Sipho Mahayi, principal property practitioner

When a seller moves the signing appointment at the conveyancer twice, the sale has changed condition, even though nothing on paper says so. The first postponement comes with a clear reason, usually work. The second comes with a vaguer one. A signed offer to purchase binds the seller, but transfer still needs the seller's signature on the documents that let the conveyancer act for them at the Deeds Office, so a seller who keeps avoiding the pen is holding up everything behind it.

Repeated postponing is usually saying something that has not been said out loud. Perhaps a spouse never really agreed to the sale. Perhaps the seller has not found anywhere to move and is frightened of ending up without a home. Most of these can be worked through once someone asks directly. What does not work is treating the second missed appointment as a diary problem and booking a third. The buyer, meanwhile, is holding a bond approval that will not stay open forever and a removal truck on standby.
